The Supreme Court of Justice Put an End in the Case Concerning the Dismissal of the GRT Council of Observers

On Wednesday 12 September,The Supreme Court of Justice ruled in favor of People’s Assembly from Comrat (APG), thus legalizing the new membership of the GRT Council of Observers (CO). In this way, the scandal between the former membership of the Council of Observers and the People's Assembly, which has been going on since last year came to the end.

We remind that on 21 December 2017, the Gagauz People’s Assembly (APG) dismissed the entire membership of the CO on the grounds that it had detected several irregularities in the company management. On their turn, the members of the CO reached out to the court, but their claim to cancel the APG's decision was dismissed as ungrounded.
Then the complaint was filed with another court – the Comrat Court of Appeal, which ruled in favor of the former members of the CO and canceled the APG's decisions.
This time, the members of APG did not agree with the court's decision and appealed it to the Supreme Court of Justice. They argued that they had acted in accordance with the Broadcasting Law of Gagauzia ATU, which stipulates that CO members are appointed and dismissed by the People’s Assembly.

By its decision of 12 September 2018, the Supreme Court of Justice cancelled completely the decision of the Comrat Court of Appeal of 28 June 2018 and left in force the APG decision on the dissolution of the CO old membership and appointment of the new members.

Mihail Sirkeli, the executive director of the NGO Piligrim-Demo from Comrat, commented for Media-azi.md that the conflict within the GRT was essentially related to the internal political fights aimed to take control over the media in the region. Sirkeli also criticized the provisions of the current Broadcasting Law of Gagauzia, which allows members of APG to dismiss CO members.

Ion Bunduchi, the executive director of the Electronic Press Association (APEL) also mentioned in a comment for the Mass Media in Moldova magazine that GRT continues to be politically influenced, and the legal amendments led to the dismissal of many members of the administration over the last years, which were accompanied by public scandals.
The decision of the Supreme Court of Justice is irrevocable.
