The BCC Sanctioned TVC 21 and Omitted the Issue of TV8 License from Agenda

On November 7, 2008, the members of the Broadcasting Coordinating Council (BCC) unanimously sanctioned the television station TVC 21 for not complying with the legislation on product placement in the TV program “Garik and Shurik are Visiting” [„Гарик и Шурик идут в гости”]. The TV station was fined MDL 5,000, and the outlet’s representatives admitted there were violations the program and promised to change the concept of the program.

However, the agenda of the Council’s November 7 meeting was changed, so the issue of the TV8 license transfer was no longer discussed, which gave rise to dissatisfaction.

BCC member Mariana Onceanu-Hadarca said at the beginning of the meeting that she will not attend this Council meeting, because the issues on its agenda did not correspond to the agenda set previously.

“Taking into account the circumstances created by the content of the agenda, the fact that it does not fully reflect the content of the agenda of the previous meeting, I find myself forced to play a walk-on part, if I evaluated the situation well, and I don’t want to do so. That is why I will not attend today’s meeting,” Mariana Onceanu-Hadarca said, leaving the room.

Media expert Petru Macovei wrote in a Facebook post, one day before the meeting, that the issue of the TV8 station license transfer “disappeared” from the agenda of the November 7 meeting (as opposed to the previous meeting, of October 20, which was postponed due to lack of quorum). As a reminder, we shall note that the station has long been trying to transfer the broadcasting right to the public association “Media Alternativa.”

After Mariana Onceanu-Hadarca left, only five members remained in the meeting room, so BCC chairman Dragos Vicol had to announce a break to solve the situation. In order for the meeting to be deliberative, it was necessary at least six members of the BCC to be present.

Half an hour later BCC member Olga Gututui came to the meeting, having not been present in the beginning.

Initially, BCC members examined the results of monitoring the program services of several broadcasters in terms of respect of children’s rights. BCC members drew the attention of these stations to the violations found and advised them to be more cautious in the coverage of topics involving children.

The TVC 21 television was fined MDL 5,000 for the violations found in the program “Garik and Shurik are Visiting”. The TV Monitoring Department of the BCC found that violations of the legislation on product placement were committed in this program.

TVC 21 Administrator Rodica Pesterean acknowledged the violations and announced that the program was suspended and will return after a re-evaluation of the concept.

The monitoring of this program was carried out at the request of the BCC member Olga Barbalata, who took note of this program “in order to encourage free competition and to place all broadcasters on equal terms.”
