The Supervisory Board (SB) of the “Teleradio-Moldova (TRM) public company examined the appeal of one of its members, Petru Grozavu, who requested that the Board annul his vote for Olga Bordeianu, which he gave during the contest conducted by SB on June 4 and 5, when she was elected as the president of the national public broadcasting company. The company’s lawyers argued that SB members cannot withdraw their votes because the law has no such provisions.

Petru Grozavu filed two appeals concerning selection of Olga Bordeianu as “Teleradio-Moldova” president. In his first appeal he proposed that SB members verify the authenticity of certificates confirming the graduation of New York Film Academy’s courses, which were in fact obtained from the Moscow subsidiary of the Academy, and the fact whether the candidate’s project of intention was plagiarized.

Olga Bordeianu, reading from paper, told SB members that she had written her project of intention herself and that so far no one could prove that it was plagiarized. She added that she had become the target of denigration companies and continued insisting on her broad experience in mass media, communication and negotiations with business people.

In his second appeal, Petru Grozavu said he wanted to withdraw the vote he had previously given for candidate Bordeianu, because he finds he was misled in terms of Olga Bordeianu’s experience in mass media.

The company’s lawyer Vitalie Covali, when asked by the SB chairman Ludmila Vasilache to comment on Petru Grozavu’s request, said the withdrawal of the vote was impossible, because the legal effect of voting had already occurred. “Neither the internal regulations of the SB, nor the Labor Code stipulate the possibility to withdraw a vote,” he said.

Referring to Petru Grozavu’s appeal to annul the SB decision on election of Olga Bordeianu as TRM president, Vitalie Covali said that it has no legal grounds. “It has already become a decision, its effect has taken place and it cannot be annulled. The Labor Code only stipulates the modification, termination or suspension of the contract. So, there is a possibility of annulment, but it can be done in court,” Covali explained.

SB members took note of Petru Grozavu’s appeals, adding that they will additionally discuss this issue. Thus, according to SB chairman Ludmila Vasilache, Olga Bordeianu will keep the position of TRM president.

At the same time, Ludmila Vasilache drew Olga Bordeianu’s attention to the fact that the SB can dismiss the company’s president if the company shows no important progress within six months after the president takes this position or if they fail to fulfill the commitments that the SB established and accepted upon their appointment.

We shall remind that Olga Bordeianu was selected for the position of TRM president by the votes of five SB members: Ludmila Vasilache, Stela Nistor, Doina Deleu, Larisa Calugaru and Petru Grozavu. Later, some information appeared in mass media and the Internet that Bordeianu falsified data about her studies at the New York Film Academy and plagiarized the project of intention that she presented for the contest. The civil society harshly criticized this decision of the Supervisory Board, and several media NGOs asked for the resignation of honor of the five members that voted for this candidate without sufficiently studying and analyzing the documents of contest participants.
